State Sovereignty Movement on the Rise
I believed, long before election day, that Barack Obama would be our next President, but I didn’t despair as many other Republicans did. In fact, I often said that he would be the best thing that could happen to the Republican Party (providing, of course, that our country survives his socialist agenda), because I believe his presidency will provide the impetus we need to once again become the fiscally conservative party.
One thing I did not foresee, however, is how Obama would spur states into affirming the sovereignty guaranteed to them by the Tenth Amendment. The recently passed “spendulous bill”, full of unfunded mandates that will ultimately demand funds from already beleaguered state budgets, has caused state governments across the nation to finally say, “Enough!”.
The Tenth Amendment states:
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.
James Madison reiterated this ideology in The Federalist Papers:
The powers delegated to the federal government are few and defined. Those which are to remain in the state governments are numerous and indefinite. The former will be exercised principally on external objects, [such] as war, peace, negotiation, and foreign commerce. The powers reserved to the several states will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people.
States with resolutions currently being considered include Texas, New Hampshire, Oklahoma (whose resolution has already passed the state house), Montana, Missouri, Hawaii, Michigan, Washington, Arkansas, and Arizona. Some resolutions, like the one in Montana, are focused on the protection of the right to bear arms, where as the resolution in Missouri concerns itself with the ability to protect pro-life legislation passed by the state.
Rumblings of similar resolutions being presented in several other states gives hope that a true movement has begun and will lead to every state confirming the recognized Constitutional limits of the federal government and the responsibility of the state governments to ignore unconstitutional federal legislation, once again bringing the legality of nullification into public debate.

This is NOT a right or left issue: This is a Federalism issue; I know most of the backers of these State Sovereignty resolutions are ~not~ reacting against merely Barack Obama, but AGAINST THE FEDERAL GOVERNMENT’S USURPATION OF POWERS. If this had started under GWB (even Ronald Reagan) I WOULD HAVE supported it! CAN YOU HONESTLY SAY that YOUR RIGHTS (Federal Constitutional Rights) have ~not~ been infringed upon by The Federal Government in Washington whether a Republican or Democrat occupies the WH?? I would stand arm-in-arm with liberal/progressive Americans who also would like their state to retain its independence against the Federal Government.
Well said Jeremy; it’s a complete mystery to me why people get S—t on over and over, but still turn to the same nonsense (and I will add they do it to all walks in their own society and people, but look how international business people are treated by them; ten times better than we are).
Someone help me out here! On one of the reports a gentleman stated that he was a democrat, just like his daddy before him. No mention of policy or change through disappointment (after all, how many have lasted beyond eight years. They last longer over here, but only because the opposition has been just as poor).
It’s a bit like our loyalties in Britain to soccer teams. If the management/board do something underhand, you vent your anger at them on the terraces (or board meeting), but you still go on supporting the club just the same. That’s where the problem always lies; I think it runs out of control so often that the top people cannot stick to policy and most of their principles come too much from logic.
The die hard loyalists are unfortunately in the opposite direction; their passion for loyalty takes over their logic. You also have to remember that a part of all societies live their working lives through efficiency, organisation and control, but like so many, belief that someone has the same control over them is generally a conflict with their personality and therefore denied inside.
War? What war? I don’t remember Congress declaring war.

I think it is all a big set up anyway. You would be amazed at how closely your national problems run. People lost a lot of faith over the last ten years in the political scheming of the British and American governments, to name but two. Don’t you think it odd that Chirac, Blair and Bush (there are others, but my home computer is down so I can’t retrieve their names) all announced their intentions to step down within a few months of each other, especially as Blair claimed: “We are in the greatest economic growth period in our history (he forgot to mention we were spending money that didn’t really exist or belong to us)? I mean, who stands down from their post when they are theoretically on the verge of ultimately historic recognition.
I’m not only saying they knew the recession was coming, i’m also stating that the ‘bubble view’ as i call it not only allowed them to see it coming, but it is blinking easy to make it happen.
I’ve joined this campaign for two reasons. Firstly, the point you mentioned Shana: The states are still very much independent and will not take this for much longer (ours are politically sewn tight), and secondly, America is a leader nation; what you people do the rest of us often emulate and i want to be right slap bang in the middle when it happens (although I am not speaking civil war; brain beats brawn in the political world).
However, my point is when everyone is losing faith in the system of government, suddenly a man pops up from virtually nowhere speaking the exact words that people want to hear. You want to check the difference in sexes at your last election; perhaps you will find that this guy charms the ladies. A deep booming voice; portrayed as the loving devoted family guy; charming and quite comical.
While there were certainly those who voted for Obama because they believe in the socialist agenda his rhetoric echoes, I do think that many of his votes were garnered because his charismatic personality struck a chord with those desperate for change (especially after 8 years of Bush and Co.). And that’s exactly why ideals like ‘compulsory voting’ (another thing they are proposing over here that you do not want over there) is disastrous governing. I must admit though Shana, a few people clearly showed they didn’t have a clue, but people will dimiss the facts claiming they could have asked hundreds. I feel the best form of approach for Howard Stern is live televised broadcast, even if it is only shown on the internet to begin with. It is so they know the people are chosen randomly (I haven’t disagreed with any of the correspondents here so far, and I am coming around to all of the ideas for the cause, but that still popped in there).
The last people you want in the polling booths are people like that, but don’t get me wrong, I can fully understand why a bloke from Harlem wouldn’t know what stem cell research is or the fact that he had to lie pretty badly after agreeing to it, but how in the name of sense can these people not know who Sarah Palin is and who she represents?
Correct me if I’m wrong (and I know I’m not), but wasn’t Sarah Palin sprawled all over the news about helping out her sister, by using her influence to have a man sacked, including interviews with Mr McCain?

The resolution HJR130 is Pending Committee Action in the house of origin in Alabama. It says: “the enactment into law by the U.S. Congress of the REAL ID Act of 2005, as part of Public Law 109-13, which was adopted by the U.S. Congress in violation of the principles of federalism contained in the 10th Amendment to the U.S. Constitution…”

I couldn’t borrow 20,000,000 of your citizens, could I? Our politicians would be frightened out of there wits with you lot. Cool! I hope the influence is so strong it echoes across the Atlantic because they are throwing the kitchen sink at us (i do not know if you have that saying so i’m not being demeaning by explaining that it literally means everything).
It will be interesting to see if there will be an escalation of some sort because once the subtle tactics of big government hit the tipping point it may be too late for politicking.

I am shocked that this article points to Obama as the impetus for the state sovereignty resolutions. This movement began during the middle of the Bush administration due to the unconstitutional powers he was granting to himself. In any case, reaffirming state sovereignty is the right thing to do and this is the right time to do it.

He’s already came out with all that bull about Afghanistan and I cannot for love nor money figure why we assume a billion dollar terrorist organisation operates from a country with less exports than I have fingers.
It can’t be hard to find them; they must all be walking around with video tapes and VCRs or am I mistaken and there’s a hugely sophisticated telecommunications system in Afghanistan that the most advanced technological race on the planet cannot detect? Unlike some others, I do believe this can be stopped; congress is still made of politicians from all states and they know the guardian is turning to protect itself rather than its people. State sovereignty has only been away because of the recent war. I cannot state that this happens in America, but opposition politicians in Britain are not are not allowed to publicly condemn a war outright because of the military personnel in foreign countries (yeah, whatever).
My apologies that my messages are so long, but I am trying to make people realise that Britain is an exact example of what’s to come with oppressive governments if you do not stop it now. The business world has us by the short and curlies, let alone the government.

It is true. Former President Bush (Jr.) did many things that the States are now fighting against. There is a lag time to this.
It is not all based on fear about President Obama. Be that as it may, it is long overdue. I strongly encourage all States to redeclare their Sovereignty, and force the Federal Government to become much smaller.
I hope I am wrong, but I predict civil war, as the States find out who their real enemy is, and the enemy is larger than just our federal government, or what we perceive to be the federal government.
The real enemy is the world-wide banking conglomeration (IMF, and all the central banks).
If they have the federal government already in their control, and if they are willing to support the federal government (in actions against the States), it could be a very hard up-hill battle that the States have ahead of them.
I predict civil war (at the very least), and a very hard uphill battle against seemingly impossible odds.
But if the only two choices are to die free, or live a slave, then I believe that patriots will choose to fight, and die free.
I need to clarify why I think Obama taking office is what’s spurring this. And it’s not anything that he’s done so far- just him taking office. I can’t speak for every state, but here in Alabama, people run on fear. Now, for some reason, none of them feared the Patriot Act and Military Commissions Act or RealID in the hands of Bush. Short-sighted and ignorant? Yes, of course. But if you start discussing Obama and these acts together, suddenly those Acts seem personal and nefarious. I’m not saying this makes sense, but it’s what I’ve experienced.
Here is one that I adapted; and will be pushed from County to District to State:
WHEREAS, the Ninth Amendment to the Constitution of the United States prohibits the federal government from abusing those rights of American people which have not been enumerated in the Constitution or Bill of Rights; and
WHEREAS, the Tenth Amendment defines the total scope of federal power as being specifically that granted by the Constitution of the United States and no more; and
WHEREAS, the scope of power defined by the Ninth and Tenth Amendments means that the federal government was created by the states specifically to be an agent of the states, and of the people respectively; and
WHEREAS, today, in 2009, the states and the people are demonstrably treated as agents of the federal government; and
WHEREAS, many powers assumed by the federal government and federal mandates are directly in violation of the Ninth and Tenth Amendments to the Constitution of the United States; and
WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and
WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States; now, therefore,
SO BE IT RESOLVED, BY THE FRANKLIN COUNTY REPUBLICAN PARTY OF THE STATE OF NORTH CAROLINA,
IN ACCORD, that we hereby affirm North Carolina and her citizen’s sovereignty under the Ninth and the Tenth Amendments to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. We also demand that the federal government halt and reverse its practice of assuming powers and of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States.

This is all well and good, expect that this state sovereignty is unnecessary, and another one of those “shut up” moves by the state legislatures rather than doing what they need to do in order to curtail the federal government and act as “representatives” of the people rather than “agents” of the feds. In Article IV, Section 4 it already asserts the “sovereignty” of the states by “guaranteeing to each state a Republican form of government,” and the Tenth Amendment already reinforces that any and all powers not given to the federal government rest with the states and the people.
This is redundancy, and will serve no purpose unless and until the states actually start suing the federal government for “lack of performance” when they don’t provide the revenue or resources for the enumerated powers, or start filing “injunctions” when they overstep their powers and start forcing the state’s and people to cowtow to their unconstitutional edicts.
This is nothing more than a move in “word” that will not be enforced by “deed,” unless more energy is put into confronting the state legislators also on the “negligence” in doing their proscribed functions when the feds are either out of line, or themselves negligent in their duties.
Nothing more than more bureaucracy and looking like they are doing something, when actually doing nothing at all.
Many prove to be OBAMA’s loyal supporters. Well it is really predictable that Obama will win the election for the fact that before the election we can see how people act and whom they were belong. The change is for Obama so people wanted to change that gives a positive thing for Obama!! Mike Mayo is known for ruffling feathers wherever he goes. He takes a strictly conservative stance on finance and banking. Now the stock market slowing and lenders in need of payday loans is being blamed on Mike Mayo and his harsh criticism of some of the world’s largest banks. He has slapped an under performing tag on banks like JP Morgan Chase, Citigroup, Bank of America, BB&T Corp, Keycorp, and Bancorp and he has advised any investors to sell their shares immediately. He is no stranger to controversy.

The Tenth Amendment (Amendment X) of the United States Constitution, which is part of the Bill of Rights, was ratified on December 15, 1791. The Tenth Amendment restates the Constitution’s principle of federalism by providing that powers not granted to the national government nor prohibited to the states by the constitution of the United States are reserved to the states or the people.
Sounds insane that would be forced through in thus age but you never quite know.
Im not sure that pushing this spending bill through so quickly is the best way forward for the country longterm, or even short term for that matter.
